1. Agreement and operator
By accessing or using this website, you agree to these terms. If you do not agree, do not use the site. NovaVend is an operating brand of WCAP Detailing Inc., referred to here as “NovaVend,” “we,” “us” or “our.”
2. Website purpose
The website provides general information about NovaVend’s managed-vending services, placement inquiries, product suggestions and machine support. Website content is informational and may be changed or removed without notice.
A placement inquiry or other form submission is not an acceptance, quote, offer, guarantee of service or binding service agreement. Any placement, commercial terms and ongoing service obligations must be agreed separately in writing by authorized representatives.
3. Forms and responsible use
You agree to provide information that is accurate to the best of your knowledge and to use each form for its stated purpose. You must not submit:
- payment-card numbers, passwords, government identifiers or unnecessary sensitive information;
- content that is unlawful, threatening, abusive, defamatory, fraudulent or infringes another person’s rights;
- malware, automated spam or material intended to interfere with the website; or
- another person’s personal information unless you are authorized to provide it.
You retain ownership of content you submit. You give NovaVend permission to use it only as reasonably needed to review the request, provide support, operate the service and meet legal obligations, as described in the Privacy Policy.
You may not use the site to:
- break a law or encourage unlawful activity;
- probe, bypass or interfere with security or access controls;
- overload the service, scrape it at an unreasonable rate or send automated submissions;
- misrepresent your identity or affiliation; or
- copy, modify or exploit the site except as permitted by law or with written permission.
We may restrict access or disregard submissions where reasonably necessary to protect the site, NovaVend or other people.
4. Machine pages and support
Machine pages identify the configured location and provide product-suggestion and support routes. Availability, product selection, pricing and machine status may change. A report does not confirm a refund, credit, fault or response time.
This website does not collect or process card numbers. Do not enter full card details in a support description.
5. Intellectual property
The NovaVend name, approved logos, site design, copy, graphics and original site materials are owned by or licensed to WCAP Detailing Inc. and are protected by applicable intellectual-property laws. These terms do not transfer any ownership rights. Limited personal viewing of the public site is permitted; other reproduction or commercial use requires prior written permission unless allowed by law.
Third-party names and marks remain the property of their respective owners.
6. Third-party services and availability
The site uses or links to third-party services, including email delivery, website hosting and optional analytics. Their services and websites are governed by their own terms and policies. A link does not mean NovaVend controls or endorses all third-party content.
We work to keep the site available, accurate and secure, but do not promise uninterrupted or error-free access. Maintenance, internet failures, provider outages or security events may affect availability. You are responsible for using an up-to-date browser and taking reasonable precautions on your device.
7. Disclaimers and liability
To the extent permitted by law, the website is provided on an “as is” and “as available” basis without warranties about uninterrupted availability, completeness or fitness for a particular purpose. Nothing in these terms excludes an express written commitment in a separate agreement or a warranty or consumer right that cannot lawfully be excluded.
To the extent permitted by law, NovaVend and WCAP Detailing Inc. are not liable for indirect, incidental, special or consequential loss arising only from use of, or inability to use, this public website. This limitation does not apply where liability cannot legally be limited, and it does not replace terms governing a physical machine transaction or a separate written service agreement.
8. Governing law
These terms are governed by the laws of Nova Scotia and the federal laws of Canada applicable there, without regard to conflict-of-law rules. Subject to rights that cannot be waived, disputes concerning these website terms are to be brought in the courts of Nova Scotia.
9. Changes and severability
We may update these terms by posting a revised version and changing the effective date. Continued use after a change means the revised terms apply from that point forward. If a provision is found unenforceable, it will be limited or removed to the minimum extent necessary and the remaining provisions will continue.
